Terms of Service

By accessing and using FabricateIQ's services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, you should not use our services.

FabricateIQ provides an energy-intelligent manufacturing platform that includes:

• Real-time machine monitoring and visibility
• Energy consumption analytics and optimization
• Overall Equipment Effectiveness (OEE) tracking
• Predictive maintenance capabilities
• Sustainability reporting tools

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and up-to-date

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the service or servers
• Transmit any malicious code or harmful content
• Reverse engineer or attempt to extract source code
• Resell or redistribute the service without authorization

You retain ownership of all data you submit to the platform. By using our service, you grant us a license to use, process, and analyze your data solely for the purpose of providing and improving our services.

If you subscribe to a paid plan:

• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• We may change pricing with 30 days' notice
• Late payments may result in service suspension

To the maximum extent permitted by law, FabricateIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

For Enterprise customers, specific service level agreements may apply as defined in your subscription agreement. Standard uptime commitment is 99.9% for production environments.

Either party may terminate this agreement at any time. Upon termination:

• Your access to the service will be discontinued
• You may request export of your data within 30 days
• All outstanding fees become immediately due

We reserve the right to modify these terms at any time. We will provide notice of material changes via email or through the platform. Continued use after changes constitutes acceptance of the new terms.

These terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
